Service Specific Terms & Conditions (“SSTC”) – Hotlink Postpaid Rate Plan Upgrade Flash Deal: Bill Rebate

- The Offer: Hotlink Postpaid Rate Plan Upgrade Flash Deal: Bill Rebate.
- You: Person(s) who is/are eligible to sign up for the Offer.
- Offer Period: 10 April 2023 until further notice. Any changes to the Offer Period is subject to Maxis’ discretion.
- Benefit: Bill rebate subject to and in accordance with the terms and conditions of the Offer you accepted.
- This Offer and your use of the Service(s) is subject to the General Terms & Conditions (“GTC”), this Service Specific Terms & Conditions – Hotlink Postpaid Rate Plan Upgrade Flash Deal: Bill Rebate (“SSTC”), Hotlink Postpaid Service Specific Terms & Conditions (“Hotlink Postpaid SSTC”) at https://www.hotlink.com.my/en/terms-conditions/products/postpaid/sstc/, the Maxis Fair Usage Policy at https://www.maxis.com.my/en/terms-conditions/general/maxis-fair-usage-policy/ and any other applicable terms and conditions, all available at https://www.hotlink.com.my/en/terms-conditions/.
- Capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, the GTC and Hotlink Postpaid SSTC shall be construed in the following order of precedence: (a) this SSTC; (b) Hotlink Postpaid SSTC; and (c) GTC.
- We reserve the rights without liability, to revise this SSTC, the GTC, this Offer and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the plan(s) and Service(s) at https://www.hotlink.com.my/en/terms-conditions/,including changes to the Agreement. Your continued use of the Service(s), and/or plan(s) (after the Effective Date of any revision/change to the terms and conditions of the Agreement, Services, and/or plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan(s) and/or the use of the Services by giving us notice within twenty-eight (28) days from the Effective Date failing which you are assumed to have accepted the changes.

- This Offer is made available to existing Hotlink Postpaid subscribers selected by Maxis at its sole and absolute discretion based on various factors such as your usage behaviour and credit score.
- You are ineligible for this Offer if you have any outstanding payments with us.
- Notwithstanding the above, your eligibility is subject to our absolute discretion. Maxis reserves the right to change the eligibility criteria for this Offer from time to time.

- Upon Maxis making available the Offer to you via the Hotlink app, you may accept and sign-up for the Offer to upgrade your existing Hotlink Postpaid plan, provided the Hotlink account is registered under your name and is active during the Offer Period.
- Upon signing-up for the Offer, you may be eligible for the Benefit subject to the terms and conditions of the Offer.
- You can only sign up for the Offer during the Offer Period via Hotlink app.

- You are responsible for payment of all Charges associated with the Hotlink Postpaid plan you have signed up for pursuant to this Offer.

- The minimum commitment period of the Offer will be the duration of the rebate period as specified in the Offer signed up by you (“Minimum Commitment Period”).
- During the Minimum Commitment Period, you must maintain an active account and shall not:
- terminate your Hotlink mobile account or port out to another mobile service provider;
- suspend your Hotlink mobile account;
- have your Hotlink mobile account terminated for non-payment of monthly bills;
- downgrade the Hotlink Postpaid plan you had registered for pursuant to this Offer. However, any upgrade of a rate plan by you is allowed with an upgrade fee where applicable. In this case, you will still be able to enjoy the Benefit for the remaining term of the Minimum Commitment Period under your new rate plan; and/or
- change or transfer ownership of the Hotlink Postpaid plan to any other person.
- If any of the events in Clause 19 above occurs, Maxis shall be entitled to terminate and cancel the Offer and in such an event, you will no longer be able to enjoy the Offer and Benefit and may be subjected to Early Termination Fee as described in clause 19 below.
- The early termination fee is calculated as follows: Monthly Rebate Amount x Remaining Month(s) of Minimum Commitment Period

- The Offer and Benefit are not exchangeable for cash.
- The Offer and Benefit are not transferable.
- Maxis’ decision on the selection of eligible subscribers for the Offer shall be final and conclusive and Maxis shall entertain no correspondence, complaint, or appeal at any time during or after the Offer Period.
- For the avoidance of doubt, all relevant conditions under this SSTC must be fulfilled, including your Postpaid account must in good standing, in order to be eligible for any of the Benefit(s) under the Offer.
- We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your usage:-
- shows excessive usage or placing unusual burdens on our Network;
- is for unlawful activities or for suspected fraudulent activities;
- is not in accordance with the FUP; and/or
- is for commercial/non-personal purposes.
- Maxis shall not be liable to the participants or any other party for any loss or damage of whatsoever nature suffered by a participant or such other party as a result of participation or non-participation in the Offer or as a result of any act or omission on Maxis’ part.
- The terms and conditions stated herein shall be governed by the Laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
