Service Specific Terms & Conditions - Hotlink Postpaid 60: 4G Device Bundle Offer ("SSTC")

Service Specific Terms & Conditions (“SSTC”) - RM20 Rebate on Maxis or Hotlink Bill with Direct Debit Services with Mastercard® (“Campaign”)

    1. Campaign: Hotlink Postpaid 60: 4G Device Bundle Offer.
    2. Offer: Free additional 50GB 4G Mobile Internet Pass during the Minimum Commitment Period of your Maxis Device Contract.
    3. Eligible Mobile Device(s): Samsung Galaxy A06, Realme Note 60, Vivo Y03 or such other selected Mobile Devices as determined by Maxis.
    4. Participating Hotlink Plan: Hotlink Postpaid 60 only, which terms and conditions are set out in Service Specific Terms & Conditions - Hotlink Postpaid 30, 45, 60 and 70 at https://www.hotlink.com.my/en/terms-conditions/products/postpaid/sstc/ ("SSTC - Hotlink Postpaid 30, 45, 60 and 70").
    5. Maxis Device Contract(s): Maxis Device Contract with a mandatory Minimum Commitment Period of twelve (12) months, which terms and conditions are set out in Service Specific Terms & Conditions - Maxis Device Contract at https://www.maxis.com.my/en/terms-conditions/devices/contract/device-contract/ (“SSTC - Maxis Device Contract”).
    6. You: Person(s) who sign(s) up and participate(s) in this Campaign.
    7. Campaign Period: Effective from 1 August 2024 until 31 January 2025 (both dates inclusive).
    8. The Campaign, Offer and use of the Service(s) is subject to:
      1. the General Terms & Conditions (“GTC”) at https://www.hotlink.com.my/en/terms-conditions/hotlink/general/;
      2. this Service Specific Terms & Conditions - Hotlink Postpaid 60: 4G Device Bundle Offer (“SSTC”)
      3. SSTC - Hotlink Postpaid 30, 45, 60 and 70 as described in Clause 4 above;
      4. SSTC - Maxis Device Contract as described in Clause 5 above;
      5. Maxis Fair Usage Policy (“FUP”) at https://www.hotlink.com.my/en/terms-conditions/maxis-fair-usage-policy/; and
      6. any other applicable terms and conditions, all available at https://www.hotlink.com.my/en/terms-conditions/hotlink/.
    9. Capitalised terms herein have the same meaning as defined in the GTC.
    10. Any conflict or inconsistency between this SSTC, SSTC - Maxis Device Contract, GTC and the Summary Terms and Conditions ("STC"), shall be construed in the following order of precedence: (a) this SSTC; (b) SSTC- Hotlink Postpaid 30, 45, 60 and 70; (c) SSTC­ Maxis Device Contract; (d) GTC and (e) STC.
    11. We reserve the rights without liability, to revise this SSTC, the GTC, this Offer and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Hotlink Participating Plan and Service(s) at https://www.hotlink.com.my/en/terms-conditions/, including changes to the Agreement. Your continued use of the Service(s) and/or plan(s) (after the Effective Date of any revision/change to the terms and conditions of the Agreement, Services, and/or plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan(s) and/or the use of the Services by giving us notice within twenty-eight (28) days from the Effective Date failing which you are assumed to have accepted the changes.
    1. The Campaign is available for any new or existing customers of Participating Hotlink Plan, who sign-up and participate in the Campaign during the Campaign Period.
    2. You are ineligible to participate in the Campaign if you have any outstanding payments with us.
    3. The Campaign and Offer are inapplicable to you if you are a commercial user and/or bulk subscriber.
    1. To enjoy the Offer, you must sign-up for Participating Hotlink Plan and Maxis Device Contract with an Eligible Mobile Devicewith a Minimum Commitment Period of twelve (12) months.
    2. The Offer will be reflected in your Hotlink app within thirty (30) days from the date of your registration for the Campaign. Your Bill will also reflect the Offer from the 2nd month of your registration date.
    3. Upon expiration of your twelve (12) months’ Minimum Commitment Period, you will cease to enjoy the Offer. However, your pre-allocated Mobile Internet package for Participating Hotlink Plan will remain as long as you stay active.
    4. Unless otherwise authorised by us, the Offer is not stackable with any other promotions or Bill rebate(s) which may be offered by us.
    1. You are responsible for payment of all Charges associated with Participating Hotlink Plan both during and after the Campaign Period. Charges exclude applicable taxes.
    1. By participating in this Campaign and signing up for the Maxis Device Contract under this Campaign, you agree to be bound by the SSTC- Maxis Device Contract as described in Clause 5 and commit to a mandatory commitment period of twelve (12) months commencing from the date of acceptance of these terms and conditions ("Minimum Commitment Period"). Where applicable, with the acceptance of the SSTC - Maxis Device Contract under this Campaign, any previous device contract you had contracted for with Maxis, shall be deemed terminated as at the date of execution of Maxis Device Contract and you shall be subject to any early termination charges of such previous contract.
    2. During the Minimum Commitment Period described in Clause 20 above, you must maintain an active account and shall NOT:
      1. terminate your Hotlink mobile account or port out to another mobile service provider or terminate the Maxis Device Contract you signed up for under this Campaign;
      2. suspend your Hotlink mobile account and/or Maxis Device Contract you signed up for under this Campaign;
      3. have your Hotlink mobile account and/or Maxis Device Contract you signed up for under this Campaign terminated for non-payment of monthly Bill;
      4. change Participating Hotlink Plan you had registered for pursuant to this Campaign to other rate plan. However, any upgrade of a rate plan by you is allowed with an upgrade fee where applicable; and/or
      5. change or transfer ownership of the Participating Hotlink Plan or your Hotlink mobile account or the Maxis Device Contract you signed up for under this Campaign.
    3. If any of the events in Clause 21 above occurs, you agree that Maxis has the right to terminate and cancel the Offer and in such an event, you will no longer be able to enjoy the Offer and may be subjected to Early Termination Fee as described below.

    4. You acknowledge and agree we have the rights to block the IMEI of the Eligible Mobile Device if you are:
      1. suspected of fraud or found to have committed fraud; or
      2. you have reported to us that the Eligible Mobile Device is missing or has been stolen and have requested us to block the IMEI of the Eligible Mobile Device; or
      3. after signing up the Eligible Mobile Device under this Campaign, you fail or have failed to make full payment of any amount due to us within fourteen (14) days of the statement due date.
    1. We will not be responsible for replacing your Eligible Mobile Device or any part thereof that is lost, stolen, damaged or defective. You shall be responsible for the repair and maintenance of your Eligible Mobile Device. Should a defect or fault fall within the ambit of manufacturer’s warranty, repairs shall be subject to the applicable warranty issued by the Eligible Mobile Device manufacturer. You accept and acknowledge that the Eligible Mobile Device is subject to the Mobile Device manufacturer’s standard warranty and we shall not be responsible and/or liable for any loss and/or damage of the Eligible Mobile Device whatsoever suffered by you and/or any other party.
    1. The Eligible Mobile Device is not returnable, refundable and/or exchangeable upon your acceptance.
    2. The Offer and/or the Eligible Mobile Device are not encashable.
    3. We reserve the right at any time or from time to time during the Campaign period, to add or change the Eligible Mobile Device under this Campaign.
    4. We reserve the right to rescind any of the privileges of your rate plan in the event your line/account registered under this Campaign is not used with the Eligible Mobile Device purchased.
    5. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your usage: 
      1. shows excessive usage or placing unusual burdens on our Network;
      2. is for unlawful activities or for suspected fraudulent activities;
      3. is not in accordance with the FUP; and/or
      4. is for commercial/non-personal purposes.
    6. Maxis shall not be liable to you or any other party for any loss or damage of whatsoever nature suffered by a participant or such other party as a result of participation or non­ participation in the Campaign or as a result of any act or omission on Maxis' part.
    7. The terms and conditions stated herein shall be governed by the Laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
